Policy
Photographs of the Project Designer retains the right to document, photograph, or otherwise record all completed designs or installations of the Project and to use such documentation for promotional purposes, as outlined in the Basic Terms and Conditions of this Agreement. Additional Client Responsibilities Client acknowledges and agrees to perform the following tasks promptly and reasonably: (a) Communicate administrative or operational decisions that affect the design or production of Deliverables, and coordinate required public approvals and meetings; (b) Provide accurate and complete information and materials requested by Designer, including site plans, building plans, and elevations, as well as color/material samples and applicable codes, rules, and regulations; (c) Obtain approvals and correct copy from third parties, such as end users or donors, as necessary; (d) Proofread and approve all project documents before release, and bear the cost of correcting any errors or omissions approved by Client; (e) Arrange documentation, permissions, licensing, and implementation of necessary elements to support signage, and coordinate sign manufacture and installation with other trades; (f) Solicit bids, negotiate contracts, and establish final pricing and terms directly with fabricators or vendors. Engineering Services include the selection and specifications for materials and construction details as described in the Proposal. However, Client acknowledges that Designer is not a licensed engineer or architect, and responsibility for interpreting design drawings and the design and engineering of all work rests with Client and/or its architect, engineer, or fabricator. Implementation Client understands that estimates provided in the Proposal for implementation charges, such as fabrication or installation, are for planning purposes only and may vary. Client shall contract and pay parties responsible for implementation services directly, and Designer is not liable for the quality or timelines of such services. Compliance with Laws Designer will use reasonable efforts to ensure that Final Deliverables comply with applicable rules and regulations, such as the Americans with Disabilities Act (ADA). However, Designer makes no representations or warranties regarding compliance, and it is the Client's responsibility to ensure conformity with rules, codes, and regulations.
